3. Who You Are Suing
- Workers’ Comp: You aren’t technically “suing” your employer; you are filing a claim against their insurance policy. In most states, “exclusive remedy” laws prevent you from suing your employer in civil court for a workplace accident.
Personal Injury: You are filing a lawsuit against a third party (a driver, a property owner, a manufacturer, etc.) in civil court.
4. Speed vs. Value
- Workers’ Comp is generally faster. It’s designed to get you medical care and a paycheck almost immediately so you don’t go broke while healing.
- Personal Injury takes much longer (months or years) because of the legal discovery and trial process, but the potential payout is usually much higher because it includes non-economic damages like “loss of enjoyment of life.”
Can you ever have both?
Yes. This happens in “Third-Party” cases.
Example: You are a delivery driver (working) and get hit by a drunk driver (third party).
You also file a Personal Injury lawsuit against the drunk driver to recover money for your pain and suffering.
